All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Unless otherwise stated, Commercial Furniture PTY LTD and/or it’s licensors own the intellectual property rights for all material on Commercial Furniture PTY LTD. Terms of payment
Commercial Furniture PTY LTD currently accepts payment only via direct transfer. Details for transfer will be supplied when the deposit is due. Commercial Furniture PTY LTD will not change its bank account without directly notifying clients. Commercial Furniture PTY LTD is an Australian company and as such uses an Australian bank account. It is the responsibility of purchasers to check account details prior to transfer. Commercial Furniture PTY LTD will not take any responsibility for any payments made into incorrect accounts.
Unless otherwise agreed upon, Commercial Furniture PTY LTD requires a 50% deposit of the net total of the entire order prior to the commencement of manufacture. Delays in payment of the deposit will result in delays to delivery and Commercial Furniture PTY LTD will not be held liable for any loss incurred as a result.
Commercial Furniture PTY LTD requires the payment of the balance in full prior to the shipment of goods and all goods remain the property of Commercial Furniture PTY LTD until payment has been made by the purchaser and received by Commercial Furniture PTY LTD.
Any delay in payment of the balance in entirety will result in a delay in shipping of the items and Commercial Furniture PTY LTD will not be held liable for any loss incurred as a result of this delay.
As an Australian company, Commercial Furniture PTY LTD charges and collects Goods and Services Taxes on all relevant services and supplied goods.
Validity of Quotes
All quotes remain valid for no more than 30 days from date of development. Quotes and prices are generated to the exactness of the order and any altering of the order, including but not limited to quantities, materials, dimensions and colours, may result in changes to prices.
Quotes are generated for the purpose of one client. Quotes and prices therein are non-transferable and Commercial Furniture PTY LTD is not bound to supply products at the prices of previous quotes or quotes given to other individuals.
Cancellation of Orders
Cancellation of an order for standard items (standard items being items of a non-custom variety), after the deposit has been paid for that order, will result in the loss of the deposit. For custom made items, cancellation of the order will not be allowed and full payment will still be expected upon completion of the order and prior to shipping. Failure to pay in a timely manner, as outlined below, will result in storage fees and may result in debt recovering procedures.
Delays in payment of the balance in entirety will result in delays in shipping which will incur storage fees. Final balance must be received in entirety within one week of production completion unless prior approval for extension has been granted in writing by Commercial Furniture PTY LTD. Storage fees will be at the discretion of the manufacturer and must be payed prior to shipping.
Upon arrival in port, all storage fees incurred will be the sole responsibility of the client.
Exchange and Refunds
Commercial Furniture PTY LTD will not grant exchanges or refunds for products that have been supplied in proper working condition that match the description as provided in the invoice. Customised items may be different to original pictures or descriptions as they are unique items and are not refundable on the basis of these differences.
Where there is a shortage in the quantities received by clients for any items, clients have 3 days upon receiving the shipment to report the discrepancy. Any evidence to support the client’s claim must be presented with the report.
Where there is a difference in the items received and the specifications on the relevant invoice, clients have 3 days to report the discrepancy. Pictures on the invoice and quote are for reference only and items may vary from the pictures and this does not give reason for a refund or replacement.
Although all efforts are made to match client’s specifications, slight variances in colours, dimensions and form maybe unavoidable. Pictures are for reference only and customised items are not guaranteed to look as the original picture. Where clients supply pictures for color and form matching, Commercial Furniture PTY LTD will not be held liable for differences in colours or form of products from the pictures supplied.
Shipping terms will be agreed upon prior to the commencement of the order and prior to the payment of the initial deposit. Shipping terms must be agreed upon in writing and will take the form as outlined in the invoice provided by Commercial Furniture PTY LTD. Commercial Furniture PTY LTD will not be liable for payment of charges or fees beyond this agreement. The client has the responsibility to research and understand their responsibilities in relation to shipping terms.
Commercial Furniture PTY LTD will take 45 – 60 days to complete manufacturing from the time that the initial deposit is received in its entirety. Delays in payment of the deposit will result in delays in manufacturing time and Commercial Furniture PTY LTD will not be held liable for any losses incurred as a result of this delay.
Shipping times and ship availability may vary and times for shipping will be advised at the time of order placement.
Commercial Furniture PTY LTD may engage a third party to deliver the shipment to the customer. Commercial Furniture PTY LTD takes no responsibility in damages incurred on route from port to the client’s place of delivery.
Unloading, assembly and installation
Unless otherwise negotiated and agreed to in writing, unloading, assembly and installation is the sole responsibility of the buyer. Any damage to products during the process of unloading, assembly or installation is the responsibility of the client and Commercial Furniture PTY LTD will not be held liable for any such damage.
Faulty assembly or installation of the product is not the responsibility of Commercial Furniture PTY LTD and Commercial Furniture PTY LTD is not liable for any damage to the product or excessive wear and tear resulting from faulty assembly or installation.
